LIABILITY WAIVER

Acknowledgment of Inherent Risks

Moving services, including those provided by Red Dot Moving in Colorado Springs and surrounding areas, inherently carry substantial risks of property damage or personal injury. These risks include, but are not limited to, scratches, dents, dings, breakage, or loss of items being moved (e.g., furniture, appliances, electronics), as well as damage to apartments, homes, floors, walls, or doorways during loading, transportation, or unloading. Such risks arise from the physical handling and transportation process, regardless of the care exercised. By engaging our services, you expressly recognize, acknowledge, and unconditionally accept these inherent risks as an unavoidable and integral aspect of the moving process, effective upon your failure to object within 24 hours of receiving our confirmation email, as well as through the contact form or verbal consent during booking.

Comprehensive Release of Liability

To the fullest extent permitted by the laws of the State of Colorado, you agree that Red Dot Moving, its owners, employees, contractors, and affiliates, shall bear no liability whatsoever for any damages, injuries, or losses, including but not limited to personal injury, property damage (to apartments, homes, or items moved), loss of items, or any other harm, arising from or in connection with our services. This release encompasses all claims, whether resulting from ordinary negligence, inherent risks, or any other cause, except where gross negligence or willful misconduct is conclusively established by a court of competent jurisdiction. You irrevocably release Red Dot Moving from all responsibility for such incidents, including any damage to your property or injuries to you, your household, or third parties, during the moving process.

Irrevocable Waiver of Right to Sue

By engaging our services, you hereby irrevocably waive any and all rights to initiate legal action or pursue claims against Red Dot Moving, its owners, employees, contractors, or affiliates, for any matter related to our services, including but not limited to disputes, injuries, damages, losses, or dissatisfaction, whether based on negligence, breach of contract, or any other legal theory, except in instances of gross negligence or willful misconduct as adjudicated by a court of competent jurisdiction. You further agree that Red Dot Moving reserves the unqualified right to initiate legal proceedings against you for non-payment, breaches of this Agreement, or other violations, with you bearing all associated costs, expenses, and legal fees incurred.

Customer Responsibilities

You are solely and exclusively responsible for preparing all items for transport, including disassembling furniture, securing fragile or valuable items, and ensuring safe access to properties (e.g., clear pathways, parking spaces, permits). You must disclose any conditions that may increase risk, such as narrow stairways, heavy or oversized items, or restricted access. Failure to comply may result in delays, additional charges, or refusal of service, for which Red Dot Moving shall incur no liability. You agree to indemnify and hold Red Dot Moving harmless against any claims, damages, or liabilities arising from your failure to meet these responsibilities or any misrepresentations.

Agreement to Terms

By booking or using our services, you irrevocably agree to this Liability Waiver, our Terms of Service, and our Privacy Policy. These documents collectively constitute the entire agreement governing your relationship with Red Dot Moving. You acknowledge that you have read, understood, and accepted the inherent risks and terms outlined herein, effective through your failure to object within 24 hours of receiving our confirmation email, as well as through the contact form or verbal consent during booking.

Governing Law

This Liability Waiver is governed exclusively by the laws of the State of Colorado. Any disputes arising from this waiver or your use of our services will be resolved exclusively in the courts of El Paso County, Colorado. Should any provision be deemed invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect, binding upon the parties.
